TRE-AP asks AGU for a statement on compliance with the sentence against Camilo Capiberibe – News of Brazil

Judge Carmo Antônio de Souza, from the Regional Electoral Court of Amapá (TRE-AP), summoned the Attorney General’s Office (AGU) to, within 30 days, express interest in definitive compliance with the sentence involving the former governor and former federal deputy Camilo Capiberibe (PSB). In the event of inaction by the AGU, the judge orders the Electoral Public Prosecutor’s Office to be summoned for the same purpose within the same period of time.
This is a conviction imposed by the Superior Electoral Court (TSE) which, upon partially granting an ordinary appeal, applied a pecuniary sanction to Carlos Camilo Góes Capiberibe in the individual amount of R$ 58,520.00 for the practice of prohibited conduct embodied in the transfer of resources from the state of Amapá to the municipality of Macapá to carry out works not started before the three months preceding the election, in addition to institutional advertising in the aforementioned period of time.
The case became final and unappealable on May 23, 2022, when the defendant parties were summoned to pay the monetary fine within 30 days.
Thereafter, there was a request to divide the amount to be paid into 60 successive monthly installments, which was granted for payment in 58 installments. Afterwards, due to the default of the third and fourth installments by Camilo Capiberibe, the debt was registered as an active debt of the Union for collection through tax enforcement and communication to the National Treasury Attorney’s Office (PFN) and the 2nd Electoral Zone.
In response, the National Treasury reported that it registered in the Union’s Active Debt, under registration 23.6.23.001019-29, PA 10951.101204/2023-76, in the name of Carlos Camilo Góes Capiberibe, hence the judge’s decision to subpoena the Law Firm -General of the Union to express its opinion on the definitive compliance with the sentence.
