The President of the Federal Supreme Court (STF), Minister Rosa Weber, granted this Tuesday (2) the request presented by Minister Dias Toffoli for transfer to the Second Panel of the Court. Last week, Toffoli requested migration from the First to the Second Panel of the Court, thus occupying the seat left by retired minister Ricardo Lewandowski.

With the change, Toffoli will be able to participate in decisions involving processes remaining from Operation Lava Jato. In addition, Toffoli will be able to judge the investigation request against Senator Sergio Moro (União Brasil-PR) and against federal deputy Deltan Dallagnol (Podemos-PR) presented by lawyer Rodrigo Tacla Duran for alleged extortion.

The collegiate is also formed by ministers Edson Fachin, Gilmar Mendes, Kassio Nunes Marques and André Mendonça. The Court reported that the request was accepted after Weber consulted “the other ministers of the First Panel about any interest in the transfer, observing the rule of seniority”. The transfer of a Minister from one Class to another, when there is a vacancy available, is provided for in Article 19 of the Internal Regulations of the STF.
