The Betting Law and the websites. And why not the Jogo do Bicho and the bicheiros?

I am not one of those who understand that the regulation of the Sports Betting Law in Brazil will protect the principles of sports. And I have a logical reason based on a classic lesson from the late jurist Miguel Reale when he teaches about Law and Morality: “There are legally licit acts that are not moral”.

Gambling is the genus of a system in which gambling is one of the species. Their differences do not overcome the common identity of the most relevant element: the bet to gain money through an uncertain outcome.

The lesson of Carlos Maximiliano, the greatest reference on the process of interpreting the law, remains current: “The law, in fulfilling its social function, is only justified if it opposes what is immoral and if it represses acts contrary to the ethical sense- Social”.

The case of the “Maximum Penalty” operation implemented by the Goiás Public Prosecutor’s Office when ordering to investigate the manipulation of conduct in the Second National Division is symbolic. You didn’t bet on the result of the game, but on the number of cards, corners or penalties before a certain moment in the game.

For a player who earns R$ 10,000 the offer is R$ 150,000. There is no regulation the unlawfulness of the law. And the conduct of sports websites cannot be doubted, in that they do not exist to provide healthy practice, but as a transit to make extraordinary profits.

Hence the conclusion that the regulation of this Betting Law, as it confronts everything that is moral, will not make it less vulnerable. On the contrary, it makes it even more nebulous to enter the field of law. Corrupt and corruptors will have a regulated law to protect them.

The “jogo do bicho” runs the risk of becoming the most “honest” bet in Brazil.
