Minister Simone Tebet, of Planning and Budget, stated this Wednesday (4) that the Ministry of Finance’s proposal to deal with the impasse surrounding court orders is not yet a government decision, although it has been formalized by the Attorney General’s Office. According to Tebet, there is nothing defined in the discussion on how to resolve the problem of court sentences, which could result in a tax liability of almost R$300 billion in 2027.

The Treasury’s proposal seeks authorization from the STF to regularize a liability of around R$95 billion in court rulings, without these amounts affecting tax rules. This measure has been classified as “creative accounting” by experts.

However, the Treasury is also seeking approval to reclassify charges and interest linked to court orders as financial expenses, which would leave part of future payments exempt from tax limitations or primary result targets.

This accounting maneuver displeases the Ministry of Planning, which classifies all expenses with judgments, including charges and interest, as primary expenditure, impacting fiscal rules.

Tebet stated that Planning intends to present its own suggestion, but did not provide details about the proposal. She said she plans to debate the matter at the Budget Execution Board (JEO), a collegiate of ministers that decides on issues related to federal finances.

He highlighted that the government is looking for solutions to prevent the issue from becoming a “skeleton” in public accounts.

“What we did in the Judiciary was to create an option, because the Judiciary also systematically considers the payment of court orders to be a moratorium,” he said. He also stated that there is the possibility of Congress taking some initiative on the debts.
