The court’s analysis was prompted by a consultation with the Ministries of Ports and Airports and Transport. The folders questioned what criteria would be considered for closing the rebidding process. The TCU established 15 conditions for the closing of the rebidding process, among them the formal manifestation of the company and the public interest in maintaining the concession. Currently, seven re-bidding processes are under analysis by the TCU: Ferrovia Malha Oeste; São Gonçalo do Amarante Airport (RN); Viracopos Airport (SP); Galeão Airport (RJ); BR 163 (MS); BRs 060, 153, 262 (DF, GO and MG); BR 040 (DF, GO, MG). The Court of Accounts also opened the possibility for companies and the government to sign an amendment to the contract, with the flexibility of investment obligations assumed by companies.
