TCU ministers denied a request to suspend the salaries of two of Jair Bolsonaro’s aides who are in prison
Brasilia DF) – The Federal Court of Auditors (TCU) unanimously denied a request to suspend the salaries of two of Jair Bolsonaro’s advisors who have been preventively arrested since the beginning of May for alleged fraud in vaccination certificates against Covid-19.
The request to suspend the salaries of Max Guilherme Machado and Sérgio Cordeiro had been submitted by the Public Prosecutor’s Office to the TCU. Both are part of the team of advisors that Bolsonaro is entitled to as a former president and are paid by the Union.
According to information from the federal government’s transparency portal, Max earns a gross monthly salary of R$6,200. Cordeiro, in turn, receives R$ 13,600 as an advisor. In addition to salaries, they earned per diems to accompany Bolsonaro on trips.
In the trial, held on June 14, TCU ministers recalled the Supreme Court’s jurisprudence providing that the public administration cannot deduct the salaries of public servants solely based on absence from service as a result of preventive detention.
“Considering, therefore, the legal plausibility of maintaining the payment of remuneration to civil servants occupying positions in commission preventively arrested, the ministers of the Federal Court of Accounts, meeting in a plenary session, unanimously agree, based on arts. 1, item II, and 43, item I, of Law No. 8.443/1992, with art. 143, items III and V, item “a”, 235 and 169, item V, of the Internal Regulations of the TCU, regarding the process listed below, in not knowing the representation, for not meeting the admissibility requirements, and determining the filing of the records, informing the representative, in accordance with the opinions issued in the records”
says the Court’s decision.
