Tarcísio government says new law does not affect lawsuits against unvaccinated civil servants – 02/16/2023 – Panel

The Tarcísio de Freitas government (Republicans) stated, in a note to the Panel, that the administrative proceedings opened against civil servants who did not present proof of vaccination against Covid-19 will continue to have the legislation that determined that documentation was mandatory as a reference in their judgments.

In this way, contrary to the expectation of part of the governor’s supporters, the processes and investigations will not be closed with the new law.

In February 2022, a report by Sheet showed that more than 1,500 civil and military police officers in São Paulo were being investigated by the internal affairs departments of their institutions at the time because, even if they were obliged, they did not prove that they had taken all the necessary doses of the vaccine against Covid-19. According to police officers interviewed by the report, those investigated will respond, depending on the institution, for alleged non-compliance with an order or legal duty, and either failing to comply with or enforcing legal norms or regulations. Punishments can be suspension from work and even dismissal.
