Tacla Duran: Lewandowski fixes Moro’s case in the STF – 04/10/2023 – Power

On the eve of retiring from the Federal Supreme Court, Justice Ricardo Lewandowski dispatched this Monday (10) in the case of a defendant in Operation Lava Jato who makes accusations against Senator Sergio Moro (União Brasil-PR).

The minister determined that the Supreme Court proceed with statements made by lawyer Rodrigo Tacla Duran against Moro and against former prosecutor Deltan Dallagnol, now a federal deputy for Podemos-PR.

The lawyer accuses Moro of attempted extortion.

Lewandowski established the competence of the STF to analyze the case and determined that the PGR (Attorney General of the Republic) make a more detailed analysis of the facts and evaluate any request to initiate an investigation. “At least in this initial phase, the competence for supervising and investigating the facts reported in the present file rests with the Supreme Court,” he wrote.

According to Lewandowski, the PGR stated that the chronology of the facts exposed “points to the possible interference of Sergio Moro in the judgment of the processes involving Operation Lava Jato – including the processes involving Rodrigo Tacla Duran”.

According to the Prosecutor’s Office, this would have happened even after Moro’s dismissal from the position of judge, “also going through acts practiced in the condition of Minister of State for Justice”. Moro left the judiciary in 2018 to take over a ministry in the Jair Bolsonaro government.

Tacla Duran was arrested as a result of Moro’s order in Spain in 2016, but, as he has Spanish citizenship, he was not extradited to Brazil. His preventive detention order was only revoked last month, by order of Judge Eduardo Appio, who took over the operation cases in Curitiba.

In a videoconference hearing, Tacla Duran again made accusations against Moro, which he has been doing in interviews and testimonies in the National Congress since 2017.

As Moro and Deltan now have a special jurisdiction, the Curitiba judge suspended the hearing and ordered the case to be sent to the STF.

Moro denies all the accusations and says he is against the course of the procedure in court. He said two weeks ago that the forum is a “hateful privilege” and said he would rather “be tried and tried during his term as senator like any ordinary citizen before a judge of the first instance, as long as he is impartial.”

In Lava Jato, Tacla Duran was accused of being a financial operator. Investigations showed that his law firm received more than BRL 50 million from contractors, from 2011 to 2013. He worked for Odebrecht until 2016.
