Suspect’s defense uses video to refute Moraes’ version – 07/20/2023 – Politics

The defense of the family investigated on suspicion of hostility to the minister of the STF (Supreme Federal Court) Alexandre de Moraes considers asking for a review of the jurisdiction of the case and bets on a video delivered to the Federal Police to counter the magistrate’s version that there was aggression against him.

The minister reported that he was called a “bandit”, “communist” and “bought” by a group at the airport in Rome and that his son – lawyer Alexandre Barci de Moraes, 27 – was attacked, causing his glasses to fall to the floor, last Friday (14).

The police are investigating the couple Roberto Mantovani Filho and Andreia Munarão, who were also with Alex Zanata Bignotto, his son-in-law, and Giovanni Mantovani, his son.

According to the family’s lawyer, Ralph Tórtima Filho, the video recorded by the family and handed over to the police shows the minister’s interaction when he tries to remove his son, who is outside the VIP room.

“At that moment, they say they would be identified, prosecuted in Brazil. And then Alex asks if the minister was threatening, and the minister turns to him and calls him a bandit”, says the defender.

According to him, this video is important to show that there was no hostility towards the minister.

“The video is important in the sense of showing that in the only moment when there is audio of the situation, which is practically the moment when Minister Alexandre de Moraes is close to these people, no offense is directed at him”, he says. “If they had been there offending him, most likely any one of them would have directed some offense, and that never happened.”

The lawyer states that he will ask the STF to have access to the case files. “As soon as we have access, we will evaluate what measure to take in relation to this circumstance”, he says, confirming that there is the possibility of requesting a review of the competence of the process.

Experts heard by Sheet point to a competence problem in the case. He should be conducted in the first instance, because the suspected businessman and others involved have no special jurisdiction, they say.

The defense claims that there was disproportionate treatment given to the suspects.

This Tuesday (18), the Federal Police carried out a search and seizure warrant at the couple’s residence. The PF stated that it complied with the warrants “within the scope of the investigation that investigates the crimes of injury, persecution and contempt committed against the minister of the STF”. A computer and cell phone were seized.

Although the aggression has been repudiated, based on the information that is public so far, experts say that the suspects’ conduct could, in theory, be classified as crimes against honor, bodily harm or acts of fact, as aggressive acts that do not affect physical integrity are called.
