STJ postpones judgment on request for Robinho to serve time in Brazil – 02/08/2023 – Sport

The STJ (Superior Court of Justice) postponed the judgment of the Italian government’s request for former player Robinho to serve in Brazil the sentence imposed on him in that country.

The former AC Milan and Santos striker was ultimately sentenced to nine years in prison for raping a young Albanian woman in a nightclub in 2013.

Faced with the fact that Brazilian citizens cannot be extradited, Italian authorities asked for the punishment to be carried out in Brazil.

The trial at the STJ had begun in April, with the vote of the rapporteur, Minister Francisco Falcão. Next, there was a request for a view (more time to analyze the case). The debate would resume this Wednesday, but Falcão was unable to attend the session. The analysis is expected to take place on the 16th.

According to an investigation by the Italian Public Ministry, Robinho and five other Brazilians committed group sexual violence against a woman of Albanian origin, who, drunk and unconscious, was taken to the dressing room of a nightclub in Milan, where she was raped several times.

Because they left Italy during the investigation, four men could not be notified, and their case was dropped from the proceedings.

Robinho has always denied the crime, and his defense points out flaws in the process that would not have been taken into account at the trial. Before one of the trial sessions in Italy, the defense stated that the former player is innocent and was “butchered by the media”.

In previous judicial phases, the athlete’s lawyers maintained that there was no evidence that the relationship with the woman –who is now 31 years old and lives in Italy– was not consensual.

In 2020, the attacker spoke about the episode to UOL.

“I regret having cheated on my wife. This is my regret. Regarding the phrases that came out: out of context and to sell a newspaper and magazine… Obviously, I’ve changed a lot from seven years to here. This happened in 2013 , and I changed for the better. The question is: what was the mistake I made? What was the crime I committed? The mistake was not being faithful to my wife. I didn’t make any mistake of raping someone, of abusing someone girl or date her without her consent,” he said.

In June, UOL released audios of conversations between Robinho and friends of the former athlete that were part of the material used by the Italian prosecutor in the process that condemned the Brazilian for collective rape.

In one of the excerpts recorded by the police through a wiretap installed in a car, Robinho spoke with Ricardo Falco about how they would respond to the rape accusation that weighed against them both.

“The girl knows you didn’t do shit to her, is she an idiot? We’re going to punch her in the face. You’re going to punch her in the face, she’s going to say: ‘Fuck, what did I do to you?”, he said. the former player.

According to UOL, there are more than ten hours of listening that became the main evidence in the process that ended with the conviction of Robinho and Falco to nine years in prison for collective rape. The sentence passed through the three instances in the courts of Italy, and there is no further appeal.
