STF to investigate Bolsonaro government for false information about Yanomamis

The STF detected non-compliance with court orders and indications of providing false information, which will be investigated

The Federal Supreme Court (STF) identified the provision of false data on actions involving the Yanomami population, which is experiencing a serious health crisis with malnutrition, malaria and mercury infection, in addition to detecting non-compliance with court orders issued in 2020 by the Bolsonaro government .

According to information from Minister Luís Roberto Barroso’s office, these signs, which occurred during the government of Jair Bolsonaro (PL), will be investigated.

“If those responsible are identified, they will undergo due legal process for punishment,” said the minister’s office, which is the rapporteur for actions on the situation and protection of indigenous peoples in the country.

Since 2020, the STF has issued several decisions ordering the Union and federal entities to take a series of measures in favor of this indigenous people.

Within the scope of the Arguição de Descumprimento Fundamental (ADPF) 709, under the report of Minister Barroso, the STF ordered the execution of a plan to combat Covid-19 for indigenous peoples that included food safety measures and broad health care, the creation of of sanitary barriers to prevent the entry of third parties in the areas and the priority of vaccination of such peoples.

In another process, which is being conducted in secrecy, the STF ordered the execution of a plan to expel invaders from the Yanomami Indigenous Land and six other indigenous lands, where prospectors and loggers are illegally present.

Invaders exit

The ordered measures included the interruption of the supply of food, fuel and essential items to the illegal mines, in order to cause the invaders to leave without acts of violence from the interior of the indigenous land; as well as action with the use of force to contain acts of violence and protect endangered communities and the permanence of troops in the area.

In addition to these measures, at the request of the Articulação dos Povos Indígenas do Brasil (Apib), the STF granted an injunction determining the immediate adoption of all necessary measures to protect the life, health and safety of the indigenous populations that inhabit the Yanomami Indigenous Lands and Mundurucu.

The Union informed that it carried out food and nutritional surveillance, general health and fight against malaria actions among the Yanomami people. He also declared the carrying out of several cycles of “operations to repress illegal mining in the Yanomami Indigenous Land”.

However, the STF is now investigating whether this information was false and whether there was a failure to comply with a court order.

Omission

For the Federal Public Ministry (MPF), the situation of the Yanomami population is the result of the failure of the Brazilian State to ensure the protection of their lands. The indigenous people who inhabit the land, located in Roraima, suffer from cases of malnutrition and malaria.

“In fact, in recent years there has been an alarming growth in the number of prospectors within the Yanomami TI, estimated at more than 20,000 by the Hutukara Associação Yanomami”, observes the note.

Minister of Justice and Public Security, Flávio Dino, determined on Monday (23/1) that the Federal Police launch an inquiry to investigate the crimes of genocide and omission of aid in the humanitarian emergency of the Yanomami communities.
