The Minister of Indigenous Peoples, Sônia Guajajara, said this Friday (27) that the President of the Federal Supreme Court (STF), Rosa Weber, hopes to complete the judgment on the thesis of the time frame for demarcation of indigenous lands this year.

“Is it over there [Rosa Weber] signaled that the time frame will be judged in its management”, said the minister to vehicles of Empresa Brasil de Comunicação (EBC). Rosa Weber turns 75 on October 2, when she is due to retire from her court post.

According to the legal coordinator of the Articulação dos Povos Indígenas do Brasil (Apib), Maurício Terena, the STF minister said that the judgment is a “commitment” of her management. Terena also had a meeting with Rosa Weber on Friday.

In the action, the ministers of the Supreme discuss the creation of the so-called temporal framework. According to the thesis, defended by landowners, the indigenous people would only be entitled to the lands that were in their possession on October 5, 1988, the date of enactment of the Federal Constitution, or that were in legal dispute at the time.

The trial was suspended in September 2021 after a request for a review by Alexandre de Moraes. The score is tied at 1 to 1, with the vote of the rapporteur, Edson Fachin, contrary to the establishment of the milestone, and a divergence opened by Nunes Marques.
