STF prohibits destruction of evidence in investigation against Lava Jato hackers

The Federal Supreme Court (STF) upheld the decision that determined the preservation of evidence obtained in Operation Spoofing, by the Federal Police (PF), which investigated hacker attacks on cell phones of authorities. The judgment took place in the virtual plenary of the Court, a modality in which ministers enter their votes in the electronic system and there is no in-person deliberation. Voting ended this Monday (12).

The operation was launched in 2019 to investigate hackers who disclosed exchanges of messages attributed to the former coordinator of Lava Jato in Paraná, Deltan Dallagnol, and former judge Sergio Moro, former holder of the 13th Federal Court of Curitiba, responsible for the operation processes. .

The preservation of the evidence was guaranteed by an individual decision handed down in the same year by Minister Luiz Fux, who complied with the PDT’s request to protect the material, informed Agência Brasil. By unanimous vote, the magistrates the current rapporteur of the action, Minister Dias Toffoli, in order to countersign the injunction.

“The court confirmed the understanding that the destruction of evidence can frustrate the effectiveness of the Justice’s action, contrary to constitutional precepts such as the rule of law and legal certainty. of obtaining these elements of evidence”, said the Supreme Court, in a note.
