STF denies PT injunction to bar Copel’s privatization – 07/05/2023 – Panel

Minister Luís Roberto Barroso, of the STF (Supreme Federal Court), denied the request for an injunction made by the PT to try to prevent the general meeting of shareholders of Copel (Companhia Paranaense de Energia) scheduled for Monday (10).

The injunction was requested by the PT’s national directorate in the wake of an ADI (Direct Action of Unconstitutionality) against parts of a Paraná law that allows Copel to be transformed into a company with dispersed capital and without a controlling shareholder.

According to the PT, the general meeting of shareholders must approve statutory changes in the company based on state law.

According to Barroso, the case does not have the urgency pointed out by the PT members, because, according to him, the implementation of the measures analyzed and voted on at the meeting on Monday (10) will only happen if Copel is in fact privatized.

“On return from recess [judiciário]the rapporteur of the cause, the natural judge of the process, can duly assess the required urgent protection and, eventually, stop the changes that have been made to Copel’s Bylaws, if he understands it by law”, he summarized, in a decision signed this Tuesday -Friday (4).

The merits of the action will still be analyzed after the judicial recess.

The action was filed at the STF on Friday night (30) and is signed by the national president of the PT, Gleisi Hoffmann. She responds to a request by state deputies from her party in Paraná, who are in opposition to Governor Ratinho Junior (PSD).

The law was sanctioned in November last year by the government of Paraná with the approval of the Legislative Assembly.
