STF begins to judge 70 more denounced by the PGR for acts of 8/1; Moraes votes in favor

The ministers of the Federal Supreme Court (STF) began to judge, in the early hours of this Friday (2), over 70 complaints offered by the Attorney General’s Office (PGR) of people involved in the acts of January 8 in Brasília.

This seventh block of denounced is made up of 64 people identified as alleged instigators of the acts and another six for executing the invasion and depredation of the headquarters of the Three Powers, in the investigations of Minister Alexandre de Moraes.

As in the previous six blocks of complaints, Moraes voted in favor of making them defendants, alleging the “occurrence of the so-called multitudinous crimes, that is, those committed by a large number of people, where the intersubjective bond is significantly amplified, because ‘a agent exerts influence over the other, to the point of motivating actions by imitation or suggestion, which is sufficient for the existence of the subjective bond, even if they do not know each other’”.

“The Public Prosecutor’s Office even points out that all ‘acted in a concurrence of people, united by the subjective bond for carrying out the common work, and should be strictly held responsible for their acts in equal Measures’”, he writes in the decision.

Moraes also states that those accused in these two investigations are also linked to two others that are being processed by the Court that investigate the so-called “fake news” and the practice of “digital militias” against state bodies, with the involvement of parliamentarians with forum prerogative such as Senator Flávio Bolsonaro (PL-RJ) and Deputies Otoni de Paula (MDB-RJ), Cabo Júnio do Amaral (PL-MG), Carla Zambelli (PL-SP), Bia Kicis (PL-DF) , Eduardo Bolsonaro (PL-SP), Filipe Barros (PL-PR), Luiz Phillipe Orleans e Bragança (PL-SP), Guiga Peixoto (PSC-SP) and Eliéser Girão (PL-RN).

The trial of these 70 complaints will run until June 9 in the virtual plenary, where magistrates cast votes without debate. If accepted, those cited become defendants for crimes of incitement to crime and criminal association in the investigation of the 64 named as alleged inciters, and criminal association, violent abolition of the Democratic State of Law, coup d’état, damage, qualified damage and act of destroying, disabling or deteriorating public property against the other six cited.

Since the beginning of the actions under analysis, the STF has already made 1,176 defendants denounced by the PGR.
