STF begins to judge 45 more denounced by the PGR for inciting the acts of 8/1

The ministers of the Federal Supreme Court began to judge, in the early hours of this Friday (23), another 45 complaints offered by the Attorney General’s Office (PGR) of people involved in the acts of January 8, in Brasília. In this eighth trial block, the defendants are investigated within the scope of inquiry 4921, which investigates the alleged instigators of the invasion and depredation of the headquarters of the Three Powers.

The trial takes place in the virtual plenary of the STF, in which ministers only deposit votes without debate, until 23:59 on next Monday (26). Among those cited in this trial phase are also people who actively participated in the acts.

The rapporteur for the inquiry, Minister Alexandre de Moraes, accepted in the vote (see the full text) the Public Prosecutor’s Office’s allegation that those cited in this inquiry “acted in conjunction with people, united by the subjective bond to carry out the common work”, and under the influence of one agent over the other “to the point of motivating actions by imitation or suggestion, which is sufficient for the existence of the subjective bond, even if they do not know each other”.

Moraes mentioned that those denounced for inciting the acts would have been associated with the crimes “through a stable and permanent structure set up in front of the Brazilian Army Headquarters based in the country’s capital, with the criminal desideratums of the other co-authors, in order to abruptly modify the current regime and the Rule of Law, to encourage ‘the Armed Forces to take power’ and the population, to subvert the political and social order, also generating animosities between the Armed Forces and the republican institutions”.

And he again cited in the vote the investigation of agents with privileged jurisdiction who would also be involved in the acts, such as federal deputies Clarissa Tércio (PP-ES), André Fernandes (PL-CE), Sílvia Waiãpi (PL-AP), Coronel Fernanda (PL-MT) and Cabo Gilberto Silva (PL-PB).

As a result, those cited in inquiry 4921 become defendants for the crimes of incitement to crime and criminal association.

Since the beginning of the investigations, the STF has opened criminal proceedings against 1,245 defendants. In total, 1,390 complaints were filed by the PGR. Around 250 defendants remain in prison on charges of acting as perpetrators and instigators of the acts.
