Silvinei asks the STF to disregard the summary that prevents the granting of HC

The defense of Silvinei Vasques, former general director of the Federal Highway Police (PRF), presented a Habeas Corpus in the Federal Supreme Court (STF) against Minister Alexandre de Moraes’ decision to keep Silvinei in prison. In the request, lawyer Eduardo Simão asks the Supreme Court to disregard summary 606, which prevents the granting of HC on decisions made by other ministers.
The petition was filed with the STF on January 13, 2024 and is confidential.
Silvinei has been in prison since August last year. According to the investigations, PRF agents had carried out checkpoints to hinder the movement of voters, mainly in the Northeast, where the then candidate Luiz Inácio Lula da Silva (PT) appeared to have an advantage in electoral polls in relation to the then president Jair Bolsonaro (PL ).
To date, the former director of the PRF has already had two requests for provisional release denied by Moraes. Silvinei’s defense wants the requests to be analyzed by another minister.
“Three times the defense arguments were not addressed, even reflexively. The decisions were all general, which is why the lawyers decided to face the statement of STF Summary 606 – which prohibits habeas corpus when the decision is made by the body itself”, said Simão.
According to the lawyer, the request for the STF to disregard summary 606 was necessary because “Alexandre de Moraes refuses to assess the merits of the issue, insisting on honoring police activity”.
The defense claims that Silvinei’s preventive detention does not meet “the legal requirements” and that the Federal Police (PF) “stalls the investigation so as not to end, allowing the illegal detention to continue”.
