Senator presents PEC to expand the right to life for the unborn child

Senator Magno Malta (PL-ES) presented a Proposed Amendment to the Constitution, PEC 49/23, to include in article 5 of the Magna Carta “the inviolability of the right to life from conception“. The proposal – which was presented with the aim of preventing the decriminalization of abortion in a trial at the Federal Supreme Court (STF) – has the support of 28 senatorss (see list below).

In justifying the PEC, the senator explains that “the omission regarding the origin of life in the constitutional text has allowed a serious attack on the dignity of the human person, who is deprived of legal protection during the gestation phase”. He mentions that this is the phase “in which human beings are most dependent on support in all aspects”.

Malta also adds that the addition – “from conception” – “adapts our Federal Constitution to current scientific advances and will have the power to guarantee the right to life of thousands of Brazilian children who are murdered due to lack of legal protection”.

“Within a few days of gestation, the embryo’s heart is already functioning. Between 11 and 12 weeks all the organs are already present in the child’s body. It is currently scientifically possible to guarantee the perfect survival of a child born after birth at just 18 weeks of age. pregnancy, something completely impossible in the 80s”, explains Malta.

The PEC awaits the appointment of a rapporteur at the Constitution and Justice Committee, where the admissibility of the proposal will be analyzed. If admitted by the CCJ, the merits of the PEC are analyzed by a special commission, which can change the original proposal. The commission has 40 Plenary sessions to vote on the proposal. The deadline for amendments ends in the first ten sessions. After the conclusion of the special commission, the proposal needs to be approved in two sessions in the Senate plenary and then in the Chamber of Deputies. Only after approval in Congress will the PEC proceed to promulgation.
