Senate CCJ will analyze Randolfe’s project on banning sound fireworks – News of Brazil

The Constitution and Justice Commission (CCJ), chaired by senator Davi Alcolumbre (União-AP), will analyze the bill that prohibits the manufacture, sale and use of fireworks and other pyrotechnic devices that produce explosions (PL 5/2022). The text was approved by the Education Commission (CE) on the 3rd and the CCJ will have the final say on it. The project is authored by senator Randolfe Rodrigues (Rede-AP).
Failure to comply with the prohibition will be covered by the Environmental Crimes Law, with a penalty of up to four years in prison — the same as that provided for the use of substances harmful to human health — and a fine of up to R$50,000 in case of use of the artifacts. Furthermore, companies that manufacture, import, transport or store fireworks may be fined up to 20% of their gross revenue.
In the initiative, the senator Randolfe Rodrigues claimed that the noise pollution produced by pyrotechnic devices exceeds the recommended limit for human hearing. Furthermore, the senator highlighted that noise causes more serious harm to children, the elderly, people with disabilities and people with autism spectrum disorder (ASD), in addition to negatively affecting animals.
The senator Paulo Paim (PT-RS), who was the rapporteur at the EC, produced a substitute for the text of the project, making it more restrictive. The original text allowed export, which Paim’s version included among the prohibited activities. The substitute also determines the destruction of illegal fireworks that may be seized.
If the CCJ approves the project, it can be sent directly to the Chamber of Deputies, unless there is an appeal for a vote in the Plenary, with signatures from at least nine senators.
