Brasilia DF) – The advocacy of the Senate concluded, in an opinion released this Tuesday (29), that the CPI of January 8 may propose plea bargaining agreements.

The body’s position paves the way for the committee’s rapporteur, Senator Eliziane Gama (PSD-MA), to suggest the collaboration of Lieutenant Colonel Mauro Cid, former assistant to Jair Bolsonaro (PL).

The opinion was requested by Eliziane and has 49 pages. The text does not evaluate the specific case of Cid, but the possibility of the commission proposing the agreements.

Senate lawyers claim that the CPI can approve a plea agreement provided that there is “participation and consent of the Public Prosecution Service regarding its terms”, ratification of the agreement by the “competent court” and provided that the collaboration “is useful for achieving the scope of the parliamentary inquiry, with effective collaboration on the part of the beneficiary”.

The Senate Advocacy also concludes that the CPI can sign a civil non-prosecution agreement provided for in the Administrative Improbity Law, also with the approval of the Public Ministry, in addition to leniency collaboration.

“The collaborating agent is entitled to the awards provided for in the legislation, according to each system and its particularities, when collaborating with the works of the CPI, and in this case it is up to the commission to postulate the benefit with the competent court”, the opinion also said.

Cid is a central character in investigations involving Bolsonaro. He has been arrested since May on suspicion of inserting false Covid vaccination data into the former president’s immunization portfolio.

He is also one of the suspects of acting in a scheme to embezzle jewelry given to Bolsonaro by foreign authorities. The president of the CPI, Deputy Arthur Maia (União Brasil-BA), has avoided dealing with the jewelry case in the committee.
