São Paulo tightens ICMS control and fits Gran Petro – 04/25/2023 – Panel SA

The fuel distributor Gran Petro was once again included by the São Paulo Treasury Department in the special regime for debts related to non-payment of ICMS in SP.

The company is not the only one targeted by the São Paulo government. The state tax authorities decided to go through a fine-tooth comb in some sectors. Fuel distribution —one of the drivers of revenue in the states— was one of the chosen ones.

The imposition of the special regime is a way for the Treasury Department to monitor the collection of the tax. If the company does not follow up with the transfers on time, its state registration may be revoked.

The inclusion of Gran Petro was published in the Official Gazette of the State on the 14th. According to information from the State Attorney General’s Office, Gran Petro’s outstanding debt exceeds R$ 121 million and is concentrated between the years 2012 to 2017.

This is not the first time that the distributor has entered the São Paulo revenue radar. In 2021, Gran Petro had its state registration revoked for accumulating more than R$ 150 million in debts with ICMS.

Sought, the company said that discussions with the tax authorities “are realities in the country, even for large companies in the market” and said that, after questioning the amounts in court, the debt was suspended.

“Gran Petro informs that it has been working on all issues relating to tax debts and that its inclusion in the ex-officio regime is yet another example of the company’s commitment to regularize alleged and possible tax debts, which, it is worth mentioning, are related to the period in which it was fighting in the regulatory and judicial spheres for the right to compete in the aviation fuel distribution market”, the company said in a note.
