Requião tries to recover retirement from the STF – 03/06/2024 – Panel

Former senator and former governor of Paraná Roberto Requião (PT) has not yet been able to resume the special pension of the former chief executive, although politicians with less time in the main chair of the Iguaçu Palace are already receiving the benefit. Requião was governor three times.

Monthly and lifetime payments had been cut at the beginning of 2020, but, in April 2023, a group of former governors from Paraná managed to recover the special pension, via a complaint to the STF (Supreme Federal Court).

As a result, five former governors returned to receive more than R$30,000 per month. Requião, who was not among the authors of that Complaint, was left out.

The PGE (State Attorney General’s Office) understands that the resumption of payments is only due to those who filed the complaint and adds that it is still appealing against the STF’s decision.

Requião also appealed to the STF against the PGE’s understanding and is awaiting a decision.

Among the five former governors are names who spent less time at the Iguaçu Palace, such as João Elísio de Ferraz Campos, who was governor of Paraná between May 1986 and March 1987; Mário Pereira, between April 1994 and January 1995; and Orlando Pessuti, who commanded the Executive between April 2010 and January 2011, when Requião resigned to run for the Senate.

Another name among the five is that of former governor and current federal deputy Beto Richa (PSDB), who governed Paraná twice, between January 2011 and April 2018, and is now 58 years old.

During her first term, in March 2011, Richa signed a decree suspending the special pension for former governors who held office after 1988, claiming that the benefit was illegal. Later, they recovered their pension, and Richa himself, in January 2019, started receiving it.

The fifth beneficiary is Paulo Pimentel, who was governor of Paraná between January 1966 and March 1971.

When appealing to the STF, Requião’s lawyer, Guilherme Gonçalves, argues that his client meets “exactly the conditions set out in the Complaint ruling”, as he is “elderly (83 years old), with no possibility of re-entering the job market (he worked in public over decades) and received the former governor’s allowance for a long period of time (between November 2012 and March 2020)”. “And, above all, he was Governor of the State of Paraná for three terms!”, continues the lawyer in the petition, which is in the hands of Minister Luiz Fux.

The STF has already declared that special pensions are unconstitutional – an issue pacified in court – and future former governors should not receive the benefit. The practical effect, however, still generates controversy regarding whether or not the payment will continue for those who already received the amounts before the court considered them illegal.
