Prosecutor Fabiano da Silveira Castanho, from the Public Ministry of Amapá (MP-AP), head of the Public Prosecutor’s Office of Pedra Branca do Amapari, recommended to the mayor of the municipality of Serra do Navio, Elson Belo Lobato (Avante), that he suspend any and all payments to the natural person of Enoque Costa Pacheco or to the legal entity EC Pacheco Cruz Ltda – ME until the provision of all information requested by the Public Prosecutor’s Office and the Municipal Council of Serra do Navio, under penalty of, regarding these payments, it is not necessary to demonstrate intent in any action of administrative improbity, in addition to the criminal consequences of the act.
The prosecutor investigates the hiring by the municipality of Serra do Navio, during the absence of mayor Elson Belo Lobato, from the business company EC Pacheco Cruz Ltda – ME to supply vehicles on lease to the municipality, for a period of one year (2022/2023) , for the value of approximately R$4 million. An internal audit carried out during the mayor’s removal from office showed that, of the 27 vehicles provided for in the contract, only 13 were made available, which reveals strong signs of overpricing, substantiated in the damage to the treasury resulting from the measurement of higher quantities and grievances actually carried out or provided.
In addition to the vehicle rental contract, there is news that the business company was also responsible for the renovation of the Cachaço bridge (where there is suspicion of using illegal wood and overpricing), as well as renting machinery for the municipality of Serra from the ship.
Preliminary surveys indicate that the partner-owner of EC Pacheco Cruz Ltda – ME is the IAPEN criminal police officer (effective state employee) Enoque Costa Pacheco, a fact that, if proven, could constitute a functional absence resulting from violations of the prohibitions provided for in the Statute of State Civil Servants (State Law 66/1993).
According to the text of the recommendation, prosecutor Fabiano Castanho says that, after analyzing statements from bank accounts in the municipality of Serra do Navio, it was found, to date, that more than R$ 3.4 had been deposited in recent years million directly into the personal account of Enoque Costa Pacheco, while in the account of the legal entity EC Pacheco Cruz Ltda – ME, more than R$5 million were deposited, therefore totaling more than R$8 million.
Castanho ordered the communication of the initiation of the procedure to the Superior Council, the General Inspectorate of the Public Ministry of Amapá and the Operational Support Center linked to the matter involved, and authorized the following steps: Letter to the government of Amapá, through the Administration Secretariat , requesting, within 15 days, the income statements of the employee Enoque Costa Pacheco for the last five years, recorded in his employment record; letter to the Municipality of Serra do Navio, requesting, within 15 days, a copy of all bidding procedures and contracts signed, under the Elson Belo administration, between the municipality and the natural person of Enoque Costa Pacheco or the legal entity EC Pacheco Cruz Ltda – ME, also informing the public servant who acted as inspector for each of the contracts.
The mayor’s failure to provide this information will lead to the filing of an action for administrative improbity, due to his history of omissions regarding ministerial requests.
The target of a process that could lead to the revocation of the rest of his mandate, and investigated for a series of irregularities in the city hall, Elson Belo, who is serving his second term as mayor of Serra do Navio, was removed from office by the City Council, but returned on September 15th by decision of judge João Guilherme Lages, from the Amapá Court of Justice.
