Minister Alexandre de Moraes, of the Federal Supreme Court (STF), determined that those arrested for acts of vandalism in Brasília will only be able to receive visits with authorization from the Justice. In the decision, the magistrate states that the custodians cannot be submitted to the same ordinance of the Criminal Execution Rod (VEP/DF) that regulates the visit to other prisoners.

According to Moraes, those who were arrested on January 9, at the Army Headquarters, can receive visits according to the rules of the Federal District prison system, which are provided for in Ordinance 008/2016, of the Criminal Execution Court.

“VEP Ordinance (Criminal Execution Court of the Federal District) 008/2016 — which regulates the entry of visitors to prisons within the penitentiary system of the Federal District — applies, fully and equally, to visits to the prison in relation to to the arrests made on 9/1/2023 by decision of this Supreme Court”, said Moraes.

The requirement was made because the investigations are still under secrecy in the STF. The suspects are investigated for crimes of criminal association, violent abolition of the democratic rule of law, coup d’état, incitement to crime, among others.

More than 900 people arrested in flagrante delicto on the day of the acts had their prisons converted into preventive ones. In other words, indefinitely.
