Pornhub sues EU over digital content law – 03/07/2024 – Tech

The website Pornhub filed a lawsuit before a European court alleging that it does not meet the criteria to be subject to strict regulations on content controls on digital platforms in the European Union, its parent company, Aylo, announced this Thursday (7).

In a statement, Aylo announced that it filed the lawsuit at the EU General Court in Luxembourg.

In December, the EU ruled that Pornhub and two other adult sites were large enough to fall under additional Digital Services Act (DSA) rules reserved for “very large” online platforms.

“We believe that the European Commission made a mistake in calculating our number of users. We also consider the requirement to be illegal… [de que] a publicity deposit be made public,” Aylo said in its statement.

Under the DSA, larger platforms must create a library of advertisements that are published on their sites.

Pornhub is seeking a court ruling suspending its advertising obligations.

According to Aylo, in January this year Pornhub had 32 million monthly active users in the EU.

Regulations determine that digital platforms are subject to stricter rules when they have at least 45 million active monthly users on the block.

When exceeding this limit, companies must submit specific reports to the EU on the possible risks their content poses and the measures taken to mitigate them.

Last year, the EU designated 22 platforms that are large enough to be subject to these specific rules. Online stores Amazon and Zalando also took legal action against their inclusion on this list.
