PIX: Central Bank will allow authorities to access user data under investigation

It applies to police officers, prosecutors and other public entities with legal attributions of criminal prosecution, control or investigation of irregularities. According to the BC, the objective is to facilitate the identification and eventual accountability of users who used the PIX to commit crimes. “Data from PIX transactions, such as transfers, purchases and withdrawals, protected by bank secrecy, will not be covered by the functionality”, said in a note Breno Lobo, consultant at the Department of Competition and Financial Market Structure (Decem) of the Central Bank. Among the data to which the authorities will have access are: username; CPF/CNPJ; registered keys; relationship institution; branch and account number; account type; key creation date; account opening date; between others. Today, data is provided in a non-automated manner, when requested by agents. Now it will be done instantly. The body states that crimes related to electronic means of payment and the speed of movement of resources reinforce the “need for greater timeliness in the exchange of information between the Bodies, aiming at greater effectiveness of actions to combat and prevent these illicit acts”. The measure is valid from the 1st of September. Reinforcement for financial institutions In May, the BC had announced measures to reinforce the security with financial institutions of transactions via PIX, to improve the infraction notification and the consultation of information linked to the PIX keys. The infringement notification allows financial institutions to identify and tag keys and users whenever transaction fraud is suspected. With the planned change, this record will have new fields to fill in. This will allow, according to the institution, the specification of notifications involving, for example, coup, embezzlement, account invasion and duress. Changing this functionality should also allow institutions to identify the type of fraud committed, such as a user who opened an account under ideological falsehood or improperly lent their account for some fraud, for example – the so-called “orange accounts”. With the consultation of information on keys, the data made available to financial institutions for anti-fraud analysis of transactions via PIX allow access to a “more relevant set of information”, which includes: data on the number of infractions of an orange account or ideological falsehood related to a user or a PIX key; number of participants who accepted notification of infringement of that user or key; number of accounts linked to a given user; in addition to presenting information related to a longer period of time. Currently, 6-month data are available, according to the monetary authority. Now, data for up to 5 years will be considered. According to the BC, these measures will come into force on November 5 because they will require adjustments to the systems, both by the monetary authority and the institutions participating in the PIX.
