PGR denounces Carla Zambelli for illegal possession of a weapon – 01/26/2023 – Politics

The PGR (Attorney General of the Republic) denounced deputy Carla Zambelli (PL-SP) on charges of illegally carrying a weapon and illegal embarrassment with the use of a weapon.

The accusation was sent on Tuesday (24) to the office of Minister Gilmar Mendes, rapporteur of the case at the Federal Supreme Court. The piece was signed by the Deputy Attorney General of the Republic, Lindôra Araújo.

In addition to the conviction for the two criminal types, the PGR asks that the parliamentarian be forced to pay R$ 100,000 for collective damages and that her carrying a weapon be definitively cancelled.

In a note sent by his defense, Zambelli said that during the course of the process “who was the victim and the real aggressor in the events that occurred” will be demonstrated. She has claimed that she acted in self-defence.

On the afternoon of October 29, the eve of the second round of the elections, the Bolsonarist deputy pulled out a 9mm pistol and chased a black man after an argument in the Jardins neighborhood, in São Paulo. A parliamentary security guard even fired a shot and was arrested by the Civil Police.

Carrying weapons is prohibited in the 48 hours prior to voting at addresses close to polling stations. The Public Security Secretariat of São Paulo reported that the chase took place more than a hundred meters from the nearest section.

Although carrying a gun, assessed the representative of the PGR, Zambelli could not have handled the pistol in public space, putting the community at risk.

The Attorney General’s Office understood that the man pursued by the parliamentarian did not pose any real danger or threat that would justify the use of the pistol and the embarrassment caused to him.

Lawyer Igor Suassuna Lacerda de Vasconcelos, who represents Zambelli in the case file, said that the defense will be presented to the Supreme Court within the legal period.

According to the note sent by Vasconcelos, the deputy “was legally authorized to carry a weapon by the Federal Police and that, during the events, she only drew her weapon because the person who unjustly attacked her and threatened her several times was arrested “.

The text also stated that Zambelli cooperated, “as he always will, with the authorities for the fulfillment of any decision regarding the matter”.

In December, the Supreme Court ordered the removal of the deputy’s firearms license and gave her 48 hours to hand over her pistol to the Federal Police.

At the time, Gilmar Mendes stated that, if the parliamentarian did not comply with the orders within 48 hours, there would be a search and seizure of the pistol and ammunition.

Earlier this month, the PF consulted the weapons registration system and discovered that the parliamentarian had three other weapons in addition to the one that had been handed over.

The minister ordered the weapons to be collected. The searches were carried out at two of Zambelli’s addresses in São Paulo, in addition to the functional apartment in Brasília. Two pistols were found, a 9mm and a 380, and a 38 revolver.

Two of these weapons were in a shooting club in Osasco. The deputy informed the police that she sent the weapon to the place for maintenance and that it would later be sold.

The parliamentarian said she understood that Gilmar’s decision would include the delivery of only one weapon and that, if she knew, she would voluntarily hand over the others.

“What strikes me the most is that the same STF that does something like that with a good citizen who has never been involved with the police, does not take any action against heavy weapons in the communities. On the contrary, right, it prevents the police from going to the communities,” he said.
