Dino explained that CACs can be arrested in flagrante delicto for failing to comply with Law 10.826/2003, which deals with the registration, possession and sale of firearms and ammunition. Legislation determines that in order to acquire and keep a firearm, it is necessary to prove suitability and not be responding to a police investigation or criminal proceedings.

“It is a situation with an unacceptable contradiction, where a person has a supposedly legal weapon, but it is not legal. And if it is not legal, the weapon ceases to be legal because it does not meet the requirements of the law, ”he said.

According to the minister, the fact that people with an open arrest warrant are in possession of weapons shows the level of disorganization with which the previous government had in relation to the weapons policy.

“We have at least six thousand weapons in this situation and we are talking about restricted use weapons, we are talking about rifles, for example. We have this situation of people who had a conviction or a preventive detention and who had supposedly legal weapons, exactly because there was a lack of control in this issue of weapons in Brazil”, he said.

Around 895,000 firearms for permitted use and over 44,000 for restricted use were re-registered, which represents 99% of the total. The deadline for re-registration in the National Weapons System (Sinarm) of the federal government ended this Wednesday (3).

According to the minister, 12,000 permitted weapons, which were not on the initial register, were re-registered. Regarding weapons for restricted use, the re-registration rate reached almost 100%. Dino stated that 6,168 of restricted use remain in an irregular situation.

Weapons that have not been re-registered may be subject to administrative apprehension and owners may be held criminally liable for carrying or illegally possessing a weapon, according to the Ministry of Justice.

Flávio Dino informed that a new decree on gun control will be presented to President Luiz Inácio Lula da Silva by May 15th. The minister pointed out that the measure is not intended to close down the arms sector in the country, but to separate the “wheat from the chaff”.

“We are going to institute new rules for the shooting club, for commercialization, restrict the quantity and we are going to present a proposal for this existing arsenal that will be discussed with other areas of government”, he said. “There was no gun control in Brazil, because there was an ideology of guns. This ideology of armamentism was functional, instrumental for private business, there were people making money with this lack of control”, he pointed out.

Until the publication of the new rules, the renewal of the registration of restricted-use weapons is suspended.

Drug trafficking

Regarding Operation Downfall, launched against a criminal organization specializing in international and interstate drug trafficking, Dino informed that BRL 1.2 million in cash were seized and assets and amounts from bank accounts and financial investments of those investigated were seized in the amount of BRL 1 billion. During the course of the investigations, around five tons of cocaine were seized.
