Pacheco defends analysis of the PEC that limits individual decisions in the STF

The president of the Senate, Rodrigo Pacheco (PSD-MG), defended this Thursday (19) the analysis of the Proposed Amendment to the Constitution (PEC) that limits individual decisions and requests for review in the Federal Supreme Court (STF). In the debate session on the proposal, the senator said that the Judiciary can be “improved”. On the 4th, the Constitution and Justice Committee (CCJ) of the Senate approved the PEC. The proposal is ready to be analyzed by the plenary, but it depends on Pacheco to be guided.
“There were many tests that our institutions underwent. Presidential removals, health crisis and, more recently, the attempt to subvert the constitutional order itself. But our institutional structure proved to be robust, strong and vigorous. It remained intact despite the attacks. The Judiciary is one of the pillars of our democracy. And let us not forget, it played a fundamental role in defending the constitutional order in the face of recent threats,” he said.
Pacheco argued that the focus of the proposal is to make the actions of the STF and other higher courts even more legitimate in society. The proposal is authored by senator Oriovisto Guimarães (Podemos-PR) and has senator Esperidião Amin (PP-SC) as rapporteur.
“PEC 8/2021 deals mainly with requests for review, declarations of unconstitutionality and granting of precautionary measures, with a focus on reducing monocratic decisions, privileging collegiality. Like the other Powers, the Judiciary needs to improve its activities, giving decisions more speed and legitimacy. The way of acting, judging and serving the people is constantly evolving. Society changes, the Law changes and the Constitution changes,” he stated.
