OAB asks for the transfer of scammers arrested to their states – 02/12/2023 – Power

The OAB asked Minister Alexandre de Moraes, of the STF (Federal Supreme Court), that the Bolsonarists arrested after the coup attacks on January 8 be transferred to the prisons of their states of origin.

The request was made by the federal council of the OAB and by the section of the Federal District. According to the Order, initially more than 1,400 people were arrested and this made the prison mass in the DF increase, at once, about 10%.

“The abrupt increase in the prison mass has caused an increase in the number of health care, escorts, lawyers and other prison routines, a fact that has a negative impact on the entire Penitentiary System”, says the entity.

This caused, says the OAB, “delay in administrative procedures, difficulty in organizing the reserved visit between lawyer and client, delay in health care, etc”, since “there was no increase in the number of criminal police officers to deal with all the demand”.

The Order also says that the prisons have a financial impact on the public coffers of the Federal District, with changes in the administrative flows of the prison units, demanding an increase in the number of employees working overtime.

“It is known that the transfer of prisoners is a common procedure that occurs between the prison administrations of the states, which takes place after authorization from the responsible courts, according to the respective laws of judicial organization”, explains the OAB.

“As can be seen, it is a bureaucratic process, since, in addition to the judicial analysis, the public administration also has to adopt budgetary and administrative procedures for carrying it out, such as authorization to remove public servants from the headquarters, payment of tickets and per diems, etc. “

Since January 8, at least 1,420 people have been arrested in the act or during operations launched by the Federal Police. Of those arrested in flagrante delicto, 916 had their prison converted into preventive (with no set period) and 464 obtained provisional release, through precautionary measures.

With less than a month since the attacks carried out by supporters of Jair Bolsonaro (PL), the PGR, through the Strategic Group to Combat Anti-Democratic Acts, has already filed complaints against more than 650 suspected of participating in the invasion and depredation of Congress buildings , the Planalto Palace and the Federal Supreme Court.

The PGR states that all the complaints “are supported by elements of conviction” and cites the “reports of arrest in flagrante delicto, expert reports verifying the damage, images of the monitoring circuits in the buildings of the three Powers and statements made by witnesses, as well as by the denounced themselves, in their interrogations”.
