The Order of Lawyers of Brazil (OAB) sent a request to Minister Alexandre de Moraes, of the Federal Supreme Court (STF), so that the people who are still arrested in Brasília for participating in the acts of January 8th be transferred to their states of origin. The letter was filed at the Supreme Court on Thursday (9) and released on Friday (10).

The letter signed by the president of the OAB, Beto Simonetti, by the Attorney General of the Federal Council of the OAB, Ulisses Rabaneda, and by the president of the OAB/DF, Délio Lins e Silva Jr. health, escorts, lawyers and “other prison routines”, causing a delay in administrative procedures.

The OAB states that the vast majority of detainees, around 1,200, come from other states and, therefore, must be transferred to their places of origin. The possibility of transfer, he says, is commonplace and is provided for by law.

“It is important to point out that, according to art. 103 of Law 7.210/84, the provisional prisoner has the right to remain in custody in a penal establishment close to his social and family environment and, therefore, the transfer of prisoners residing in another unit of the federation is a fair measure that is imposed, in view of the arguments set out here”, concludes the letter.

The order also states that it had access to reports that the appointments for the assistance of lawyers to those in custody are not being carried out in a minimally reasonable time, “even exceeding weeks, in view of the intense demand of professionals to the prison unit”.

The STF has not yet ruled on the request.

System has fewer prisoners in the acts than reported by the OAB

A survey released last Wednesday (8) by the State Secretariat for Penitentiary Administration of the Federal District (Seape/DF) points out that, currently, there are 916 prisoners in the DF penitentiary system for involvement in the acts of January 8.

There are 611 men in the Provisional Detention Center 2, in the Papuda Penitentiary Complex, and 305 women in the Women’s Penitentiary, known as Colmeia. Another 470 people were released and are being monitored by electronic anklets.
