The 2nd Chamber of Coordination and Criminal Review of the Federal Public Ministry (MPF) determined this Friday (31) that the investigation into the plan of the First Command of the Capital (PCC) against Senator Sergio Moro (União Brasil-PR) must be processed in Curitiba. The collegiate followed, unanimously, the understanding of the rapporteur, the Deputy Attorney General of the Republic Luiza Frischeisen.

On Tuesday (28), the Public Prosecutor José Soares asked that the investigation leave the federal scope and be forwarded to the State Justice of São Paulo. The Review Chamber denied the request and stressed that Soares may request “based on his functional independence, the designation of another member” of the MPF to continue the investigation. Judge Gabriela Hardt, deputy on the 9th Federal Criminal Court of Curitiba, had already rejected a similar request by Soares. The rapporteur considered that filing would be “premature”.

“Thus, bearing in mind that the investigations are still ongoing, it is possible that other evidence regarding the crimes under investigation (criminal organization, illegal possession or possession of a firearm and money laundering) will be uncovered, as well as the verification of the occurrence of other illicit acts”, he wrote.

Frischeisen defended the permanence of the case in Federal Justice and argued that “there is robust evidence in the sense that the members of ORCRIM [organização criminosa] they stayed in Curitiba/PR and the metropolitan area for more than six months, and even rented a house near Senator Sergio Moro’s residence.” “Such evidence indicates that the offenses were committed in Curitiba, which justifies, for the time being, , the continuation of the investigations before the Federal Justice of that locality”, completed the rapporteur.
