Moraes keeps 140 arrested for coup attacks and releases 60 – 01/18/2023 – Power

Minister Alexandre de Moraes, of the STF (Supreme Federal Court), maintained the arrest of 140 detainees as a result of the coup attacks on the buildings of the three Powers and released 60 people, with precautionary measures. The first group had arrest in flagrante delicto converted into preventive.

According to the advice of the STF, the minister hopes that by Friday (20) the cases of the 1,459 arrested for the act will be analyzed. He began evaluating the cases on Tuesday (17), after receiving the minutes of custody hearings between January 13 and 17.

In the decision in which he kept the 140 prisoners, the minister considered that the conduct practiced was illicit and very serious, with the intention of, through violence and serious threat, to coerce and prevent the exercise of the constituted constitutional powers.

For the minister, “there was a flagrant affront to the maintenance of the democratic rule of law, in clear disagreement with the guarantee of freedom of expression”.

“In these cases, the minister considered that there is evidence in the records of the effective participation of those investigated in a criminal organization that acted to try to destabilize republican institutions and highlighted the need to investigate the financing of the arrival and stay in Brasília of those who carried out the attacks”, explained the advisory.

Regarding the other 60 people who obtained provisional release with the application of precautionary measures, the minister considered that, “although there are strong indications of authorship and materiality in the participation of the crimes, especially in relation to article 359-M of the Penal Code (trying to overthrow the legally constituted government ), so far, no evidence of violence, invasion of buildings and depredation of public property has been gathered”.

For this reason, the minister understood that it is possible to replace the prison by means of precautionary measures such as the prohibition of leaving the district and home confinement at night and on weekends, with the use of an electronic anklet to be installed by the Federal Police in Brasília.

In addition to the obligation to report to the Judgment of Execution of the county of origin, within 24 hours and weekly attendance, every Monday and prohibition of leaving the country, with the obligation to deliver the passports at the Judgment of Execution on five-day period.

The minister also determined the cancellation of all passports issued in Brazil on behalf of those investigated, the immediate suspension of any documents for carrying a firearm and registration certificates to carry out firearms collection activities, sport shooting and hunting.

It is also prohibited for the investigated persons to use social networks and to communicate with the others involved, by any means.
