Moraes gives provisional release to autistic arrested after January 8

Minister Alexandre de Moraes, of the Federal Supreme Court (STF), granted provisional freedom to Jean de Brito Silva, 27 years old, autistic, arrested on January 9, in the camp in front of the Army Headquarters, in Brasília, with other 1,200 people. The decision was signed this Tuesday (18), after several requests for release by the defense.
When determining the provisional freedom, Moraes stated that, although Jean had joined “an armed association” with the “objective of committing crimes against the Democratic State of Law, notably the deposition of the legitimately constituted government, which had taken office in January 1, 2023”, as he has autism spectrum syndrome and moderate intellectual disability, “prison maintenance is not adequate”.
Jean will have to wear an ankle bracelet and present himself every Monday before the authorities of the Comarca de Juara (MT), where he resides.
Six months after the depredations in Brasilia, the elderly, people with comorbidities and women with minor children are still in prison without individualization of conduct. Among the 253 people who are still detained, there are several who meet the requirements for provisional release.
