Minister Alexandre de Moraes, of the Federal Supreme Court (STF), determined the reactivation of the accounts of the elected federal deputy Nikolas Ferreira on the social networks Facebook, Instagram, Telegram, Tik Tok, Twitter and YouTube. In the same decision, released this Thursday (26), Moraes determined a daily fine of R$ 10,000 if Ferreira publishes, promotes or shares news considered fraudulent.
To go back on the blockade, imposed on January 11, Moraes cited the request of the President of the Senate, Rodrigo Pacheco, in favor of Senator-elect Alan Rick, who had his accounts suspended in the same decision handed down against Ferreira. The two are investigated in Inquérito 4.923, which investigates the participation of authorities in acts of vandalism against buildings of the Three Powers, on January 8.
To suspend the accounts of the two parliamentarians, Moraes argued that the measure was “necessary, adequate and urgent” to interrupt “the eventual spread of speeches with hateful content, subversion of order and incentive to break institutional and democratic normality”.
Days later, Pacheco called the STF to intercede for Rick, so that he could return to “using his social networks in the strictest respect for the Federal Constitution and the Legislation”.
Moraes accepted Pacheco’s request and, in the decision, said he understood that there was “a cessation of dissemination of content that was illegal and tended to transgress the integrity of the electoral process and encourage the performance of anti-democratic acts”. The same argument was now used in favor of Nikolas Ferreira.
“As can be seen, although the object of the decision was the profiles of the elected Senator, the grounds used are fully applicable to NIKOLAS FERREIRA, considering also that, from the individualized analysis of the situation of the elected Federal Deputy, it appears that there was the cessation of dissemination of content that is illegal and tends to transgress the integrity of the electoral process and encourage the performance of anti-democratic acts, with the possibility of reactivating their profiles, maintaining, however, the removal of irregular posts conveyed by them” , wrote Moraes.
