Moraes after TSE condemns Bolsonaro: “Justice is blind, but not foolish”

President of the TSE, Alexandre de Moraes was the last to read the vote in the Electoral Court condemning the former president to ineligibility

Brasilia DF) – The president of the Superior Electoral Court (TSE), Alexandre de Moraes, gave the final vote to condemn the ineligibility of former president Jair Bolsonaro (PL) until 2030.

“Electoral Justice, like all justice, may be blind, but it is not foolish. We cannot create the ostrich precedent, [o qual] everyone knows how it happened, but everyone hides their heads under the ground”,

stated the minister in his vote.

Moraes voted for the conviction of the former president and the acquittal of former vice-presidential candidate Walter Braga Netto.

When giving his vote, before starting the proclamation of the result, the President of the Court stated that the decision is “the answer that the Electoral Justice will give to this question”. According to him, the TSE confirms “the faith in democracy, in the Rule of Law, because, unlike what was intended to be disclosed in recent days, mainly through social networks, the TSE is not innovating at all”, he highlighted.

“No candidate, and especially the one investigated in this action, Jair Bolsonaro, could claim ignorance of the position of this Electoral Court of the main premises that should be observed for the 2022 elections”, highlighted Moraes.

Judgment

The Superior Electoral Court (TSE) made, this Friday (30/6), former president Jair Bolsonaro (PL) ineligible. The former representative was condemned, with the score of 5 to 2, for the attacks he made on the Brazilian electoral system during a meeting with ambassadors, in July 2022. The TSE understood that there was abuse of political power and misuse of the media.

With the decision, the former President of the Republic is prevented from running for any elective office for eight years, starting in 2022. That is, he will not be able to contest the elections of 2024, 2026, 2028 and 2030.

In the Judicial Electoral Investigation Action (Aije) judged, the Democratic Labor Party (PDT) accused Bolsonaro of abuse of political power and misuse of the media during a meeting of the then president with foreign ambassadors, at Palácio da Alvorada.

According to the party, the former president attacked, at the event, the Courts of the TSE and the Federal Supreme Court (STF) and stated, without presenting any evidence, that the results of the 2022 general elections proclaimed by the Electoral Justice would not be reliable.

In addition, the PDT claims that there was a violation of the principle of isonomy between the candidacies, configuring an abuse of political power the fact that the meeting took place at the official residence of the Presidency of the Republic and was organized through the official apparatus of the Planalto Palace and of the Ministry of Foreign Affairs.

Tarcísio Vieira, Bolsonaro’s lawyer, said he will wait for the judgment “to identify the best strategy, including whether or not to go to the Supreme Court”.

“The defense receives the decision with deep respect and will await the full composition of the judgment, since mostly only partial votes or summary votes were read to identify which are the best strategies going forward.”
