The Ministry of Justice informed, this Monday (21), that it will monitor the activities of the agency 123 Milhas after the cancellation of promotional ticket packages for the year-end period. According to the folder, the reimbursement, yet, should not be imposed only by vouchers, as intended by the company in a statement issued to customers last week.

“A contractual clause that allows unilateral cancellation is considered abusive and consequently void. Reimbursement must ensure that consumers do not suffer losses and the voucher option cannot be mandatory or exclusive. The return must meet the amounts paid with possible monetary corrections”, said the ministry in a note.

The folder also stated that any damage to consumers must be reported on the consumer.gov.br platform.

Last Friday (18), 123 Milhas issued a statement informing the temporary suspension of the “Promo” line and the suspension of ticket issues with departures from September to December, due to “adverse market circumstances”.

The company stated that it will reimburse consumers through “vouchers with monetary restatement of 150% of the CDI, above inflation and market interest rates, for the purchase of tickets, hotels and packages”.

Secretary Wadih Damous said that “Senacon will notify 123 Milhas to explain the cancellation of flexible travel packages. If irregularities are identified in the reimbursement to consumers, we will open an administrative process, which may result in sanctions against the company”.

Damous also emphasizes that vouchers cannot be the only form of restitution. “The company cannot, for example, offer only the voucher option to reimburse customers, who have the right to opt for reimbursement in cash”, he added.
