Minister asks AGU to speak out against changing the park – 05/19/2023 – Panel

The Minister of Indigenous Peoples, Sônia Guajajara, asked the Attorney General’s Office to speak to the Federal Supreme Court against the change in the limits of a national park in Pará that would allow the construction of Ferrogrão.
The railroad is defended by grain producers in the Midwest to facilitate the flow of production through the North of the country, but it is criticized by environmentalists and indigenists, who see the work as a threat to the region’s ecosystem.
In the middle of the Ferrogrão route is the Jamanxim National Park, which would need to have the area altered so that the railway line can cross it.
During the government of Jair Bolsonaro (PL), defender of the work, the AGU expressed itself in favor of an attempt to change the park through a provisional measure. Guajajara now asks his colleague Jorge Messias, attorney general of the Union, to change his understanding.
The STF analyzes an action of unconstitutionality against the MP. In a letter sent to the AGU last Monday (15), the minister uses a legal argument, that the suppression of protected areas can only be done through a law approved by Congress.
At the same time, she says that “it is necessary to take into account the socio-environmental impact of reducing the park and give due weight to the debate on the construction of Ferrogrão, out of respect for the indigenous peoples who live in the region”.
