Minas Gerais court condemns Janones to pay R$5,000 to Nikolas Ferreira

The Justice of Minas Gerais issued a sentence against federal deputy André Janones (Avante-MG), referring to a lawsuit filed by federal deputy Nikolas Ferreira (PL-MG), after suffering offenses on social networks. Janones was sentenced to indemnify the congressman from Minas Gerais, in the amount of R$ 5 thousand, for moral damages.

On social media, the deputy from Minas Gerais celebrated the court’s decision. “Janones has just been sentenced to pay 5,000 reais for moral damages and for all the defamation I endured due to the lying publications where he claimed that I would respond to prosecutions for pedophilia and rape. Look at the level of this being… Justice done. First of many “, wrote Ferreira on Twitter.

The action against Janones was filed last year, during the election campaign, after he said that a “pedophile councilor” was making montages with his name. The publication was made on social networks upon learning that Nikolas was filing a lawsuit against him over the post.

“Nikolas Ferreira sued me for having said here that there is a pedophile councilor defaming me. Detail: I didn’t mention a name, and I was referring to a citizen who responds to dozens of complaints for pedophilia! What a bad conscience doesn’t do, huh? “, wrote Janones at the time.

As evidence in the action, Ferreira presented several prints of posts, of which the justice found “manifestations by the defendant insinuating the practice of criminal and morally repudiated acts”.

According to justice, it was possible to conclude that the posts were about Nikolas “without much effort” and that “there was offense to the image (of the deputy) due to the gravity of the terms used”. However, Janones’ defense tried to argue by saying that he did not publish any names.

In the sentence, the court did not accept the request to remove the post because it considered the Federal Constitution, “the right of free expression of thought and freedom of expression”. “The offense to a particular individual is not a reason, in itself, for mitigating or curtailing a constitutionally provided for right”, wrote Judge Flávio Catapani.

The retraction request was also denied by the court, considering that “the socio-political relevance at the national level of the parties and the known animosity between both” would only “increase the repercussion of the case”.

After learning of the sentence, deputy André Janones mocked “Nikolas’ victory” and attributed new reviews to the mining parliamentarian. “URGENT! Two more victories in court against Nikolas Ferreira! The Deputy asked that the court remove my posts, which were not even directed at him, and also that he be granted the right of reply! of homophobia for saying that he “took a dick”. The same in the case of the pacifier!”, wrote Janones.

On the last 20th, the justice of Minas Gerais condemned deputy Nikolas Ferreira to pay compensation for moral damages of R$ 80 thousand to Duda Salabert (PDT-MG). In the understanding of the judge of the 33rd Civil Court of the District of Belo Horizonte, José Freitas Véras, the deputy committed an offense liable to liability for refusing to use the female pronoun to mention Salabert, who is a trans woman, in an interview with the Estado de Minas newspaper.
