Rapporteur for the time frame in the Senate, Soraya Thronicke (União-MS) wants to include in the text the forecast of compensation to farmers for land demarcated by market value, not by sale.

The proposal approved by the Chamber mentions compensation for “benefits made in good faith”, that is, works carried out until the conclusion of the demarcation process.

The venal value is an estimate made by the government about the goods and is usually below the market value. According to the senator, the topic has already been dealt with by the Minister of Agriculture, Carlos Fávaro, and there is agreement by President Luiz Inácio Lula da Silva (PT).

“I spoke with Minister Fávaro and he said that Lula wants to indemnify, yes, bare land and improvements. He cannot cover one side and leave the other open”, he reports.

She is also studying how this value will be defined — whether there will be a minimum number of different assessments and who will be able to do them.

Soraya says there is an agreement to take the text to a vote in the first week of August and, in this way, to advance the judgment in the STF (Federal Supreme Court). The matter entered the agenda on June 7, but Minister André Mendonça requested a view, which now has a 90-day deadline.

There is no agreement, however, on the text’s biggest obstacle, which is the delimitation of the Constitution as a framework for the occupation of land subject to demarcation. Soraya says that she only received the report last week, after spending a period in hospital, and that she is still going to initiate conversations to reach a consensus.
