Liceu in SP: Public Ministry opens a new investigation – 02/22/2023 – Mônica Bergamo

The São Paulo Public Prosecutor’s Office (MP-SP) opened a second investigation to investigate the agreement made by the São Paulo City Hall with the Liceu Coração de Jesus school. In addition to investigating the possible practice of the crime of administrative impropriety, the body wants to look into possible violations of the right to education practiced by the management of Ricardo Nunes (MDB).

At the end of last year, the emedebista decided to sign the agreement after the priests who run the private school announced the end of its activities due to insecurity in its surroundings, in the center of São Paulo, aggravated by the dispersion of cracolândia.

Last week, an inquiry was launched by the Public Prosecutor’s Office of the MP-SP to analyze the case. The second investigation will be carried out by the institution’s Special Action Group on Education, in response to a representation by councilor Celso Giannazi (PSOL-SP).

In the ordinance that initiates the new investigation, the prosecutor João Paulo Faustinoni states that the agreement was not foreseen in any national or municipal plan. He also says that there are indications that public resources were used without the Municipal Treasury having fully complied with the priority goals established for the city’s education.

“The city hall itself, in its response to the preliminary inquiries, admits that the object of the development term is related to the Municipal Education Plan (expansion of full-time teaching), without, however, having been analyzed by the competent bodies”, says the concierge.

The Public Prosecutor’s Office asks the municipal management to prove, within ten days, that there was a demand for vacancies for early childhood education and for the initial years of education not yet met in the region of the Liceu Coração de Jesus school, in addition to data on students enrolled at the institution.

Sought out last week, the São Paulo City Hall stated that it had already provided the clarifications requested by the Public Prosecutor’s Office on the case. “The municipal administration remains at the agency’s disposal,” he said.

The signing of the agreement with the Liceu was published in the Official Gazette on December 31 and provides for the monthly payment of R$ 527,000 for the provision of 500 places in early childhood education and from the first to the fifth year of elementary school. The children have already been selected and are taking classes at the unit.

The proposal also meets a policy defended by the mayor, the outsourced management of schools. The model, however, suffers resistance and is questioned by professors and specialists in the area.

Since the agreement was announced by Nunes, experts point out that the measure may be considered unconstitutional. This is because the Constitution says that public resources can only be allocated to community, confessional or philanthropic schools “when there is a lack of vacancies and regular courses in the public network”.
