Letter against Janaina Paschoal generates rift among students – 09/02/2023 – Mônica Bergamo

A demonstration against the return of congresswoman Janaina Paschoal (PRTB) to the USP Faculty of Law by the Academic Center XI de Agosto upset students at the institution. Student representatives claim that the student body did not listen to their peers when they publicly said that the state legislator was no longer welcome and that her return caused “disturbance”.

“There is, at least so far, no legal reason to expel a duly awarded professor from her chair just because we disagree with her political activities. Action along these lines would not only violate the Citizen Constitution, but also the regulations of the University of São Paulo “, says the student representation, in a note.

Elected annually, the collegiate is composed of 59 students who represent the faculty before deliberative bodies. In their demonstration, they accuse the current management of the academic center of launching a manifesto “on behalf of more than 2,000 Franciscans” —as the students of Largo de São Francisco call themselves— without any dialogue.

“Professor Janaína, as a professor and a woman, must be respected. It should be reiterated that any position in favor of authoritarianism will not be tolerated, but will be taken to the appropriate instances. Fascism does not suit the Arcades, a space for respect, dialogue and of democracy”, say the representatives.

“Eventual political disagreements will be resolved as they always have been in San Francisco: with the free debate of ideas, respecting pluralism and the constitutional rights of freedom of expression and chair”, they conclude.

As the column showed, Janaina showed interest in resuming classes at Largo de São Francisco shortly after the 2022 elections, when she was not elected to the Senate. Graduated from college since she arrived at the Legislative Assembly of São Paulo, in 2019, she will end her term on March 15.

“You don’t fit in here anymore. Our classrooms have become too big for you”, said the note prepared by the Centro Acadêmico XI de Agosto, which until the beginning of this week organized a petition in opposition to the return of the teacher to the classroom. of class.

Janaina’s participation as the author of the request for impeachment of Dilma Rousseff (PT) was criticized in the document, as well as her absence among the signatories of the letter in defense of democracy articulated during the 2022 electoral process.

“Since becoming one of the leaders and the main legal guarantor of the extreme right, Janaína has abandoned the democratic values ​​that should permeate the classrooms of the main institution of legal education in the country”, said the text.

Sought by the column, Janaina Paschoal said that she will fulfill her duty by returning to college, since her license will come to an end, and that protests are part of democracy, but should not exceed “the limits of the expression of thought”.

“When no one spoke of quotas, I defended them. While many colleagues are the children and grandchildren of diplomats and judges, I am the granddaughter of migrants from the Northeast and come from the outskirts of São Paulo. , and I will return”, said the deputy.

“As for the protests, they belong to democracy, as long as they do not go beyond the limits of expression of thought”, he added.

“The FDUSP student representation publicly expresses its support for the text “Arcades are big, because all their teachers can fit in them”, published yesterday by Professor and former Director of São Francisco, Floriano de Azevedo Marques Neto.

The democratic commitment repeatedly reiterated by RD makes it clear that we disagree with the ideas and positions of Professor Janaina Paschoal. We do not agree with her defense of conservative agendas, and her connection with Bolsonarism must be condemned in the political sphere.

However, we are in a Faculty of Law. There is not, at least up to the present moment, any legal reason to expel a duly publicized professor from her chair, just because we disagree with her political actions. Action along these lines would not only violate the Citizen’s Constitution, but also the regulations of the University of São Paulo.

Thus, despite the legitimacy of the Travessia administration to propose possible positions of the XI de Agosto, we disagree with the position adopted. They did not consult the students, launching a manifesto on behalf of more than two thousand Franciscans and Franciscans without the dialogue that a question of such sensitivity requires.

Professor Janaína, as a teacher and a woman, must be respected. It should be reiterated that any position in favor of authoritarianism will not be tolerated, but will be taken to the appropriate instances. Fascism does not suit Arcades, a space of respect, dialogue and democracy.
