Lawyer says victim recognized Cuca as ‘rapist” – 04/25/2023 – Sport

Lawyer Willi Egloff, who represented the rape victim in Switzerland in 1987, said she recognized Cuca as one of the attackers and that his semen was used as evidence. In his presentation interview at Corinthians, Cuca said he had not recognized the victim.

Willi Egloff said Cuca was recognized as a “rapist” by the 13-year-old girl attacked in a hotel in Bern, Switzerland, in 1987. The lawyer said: “Alexi Stival’s statement [Cuca] it’s fake. The girl recognized him as one of the rapists. He was convicted of sexual relations with a minor.”

Egloff also confirmed information from the newspaper Der Bund, from Bern, according to which Cuca’s semen was found on the girl. According to him, the examination was carried out by the Institute of Forensic Medicine at the University of Bern.

The lawyer stated that the victim of the Grêmio players tried to commit suicide after the crime. Egloff said he was asked by the victim’s father to accompany him during the process, which lasted two years and ended in 1989, with the conviction of Cuca and three other players.

Egloff had been practicing law for four years when he was approached by the victim’s father to help with the complaint. Graduated from the University of Zurich in 1974, he acted in the case and had access to the case files. Today he works in an office and provides consultancy in the areas of media law and copyright.

Alexi Stival, Cuca, denied any involvement in the crime, saying that he was just in the room when the girl was surrounded by the other players. According to him, in three statements, the victim said that he did not attack her. Can you confirm or deny this version? Did the victim recognize you as one of the criminals?
Egloff: Alexi Stiva’s statement is false. The girl recognized him as one of the rapists. He was convicted of sexual relations with a minor.

Der Bund newspaper mentions that Cuca’s semen was found on the victim. Do you confirm that this was one of the evidence used in the process? Do you remember how this exam was done? In 1987, forensic DNA analysis was still in its infancy.
Egloff: It is correct that Alexi Stival’s semen was found on the girl’s body. The examination was carried out by the Institute of Forensic Medicine at the University of Bern.

The same article mentions that the victim attempted to commit suicide after the crime. Did this really happen? We wouldn’t want to invade the victim’s privacy, but this information would help the public understand the extent of the trauma she went through.
Egloff: This information is correct. However, I don’t remember for sure whether this happened immediately after the event or later.

Brazilian journalists have been trying to gain access to the full Swiss court case, but it is currently under wraps. These documents would be important to verify the veracity of Cuca’s allegations. Is there any way to access this process?
Egloff: As the case was carried out under privacy protection, it is difficult to access the file.

Do you remember exactly what crimes the defendants were convicted of? Can you mention the article of the Swiss Penal Code they violated?
Egloff: Alexi Stival was convicted of violating art. 181 (coercion) and art. 191 (fornication with children) of the Swiss Penal Code. Since then, the Swiss Penal Code has been revised several times. The old art. 191 corresponds to art. 187 (sexual acts with children) of the current Swiss Penal Code.

How did you find out about the crime? How did you meet the victim and her parents and what was her role in the process?
Egloff: I was hired by the father [da vítima]. As the victim’s attorney, I had full access to the file.
