Lawyer Walber Agra, author of the PDT action that could make Jair Bolsonaro (PL) ineligible, announces on his website which maintains a partnership with the office of André Ramos Tavares, 1 of the 7 ministers participating in the ongoing trial at the TSE (Superior Electoral Court) against the former president.

Both have written books and worked together. Tavares was president of the Electoral Judiciary School, a body of the TSE, and had Agra as deputy, when the head of the court was then Minister Ricardo Lewandowski, in 2011.

Wanted, the labor party lawyer claims he never acted in any process in partnership with the current minister. “We worked together at the Superior Electoral Court a long time ago when I was his deputy, but professionally we have absolutely nothing together. No process”, he says.

She claims that the site’s ad it happens because, “if there was the possibility, I would really like to have a partnership with him in the area of ​​opinions”, but that “this was never possible”. The Agra page informs that it has nine other offices as “partners”, among them André Ramos Tavares Consultoria Jurídica.

The report sent questions to the TSE advisory, but received no response.

Tavares was nominated by President Lula (PT) to be a titular member of the court at the end of May. He was already a substitute minister of the court since November last year, when he was appointed by Bolsonaro to the position.

Tradition dictated that the oldest substitute magistrate, Maria Claudia Bucchianeri, ascend to the title. However, thanks to an articulation by the president of the TSE, Alexandre de Moraes, Lula ended up choosing Tavares for the post.

Doctor in Law from USP, he has published several books, some of them co-authored with Walber Agra. These are the cases, for example, of the works “Constitutionalism, The Challenges of the Third Millennium” and “The Electoral Law and the New Code of Civil Procedure”.

He will be the fourth to vote in the trial that will resume this Thursday (29) and that could revoke Bolsonaro’s political rights until 2030.

If he and the two ministers who preceded him in the vote take a stand for the former president’s ineligibility, as did the rapporteur, Benedito Gonçalves, on Tuesday (27), Tavares will be responsible for giving the vote that will form a majority against Bolsonaro.

When he was campaigning to become substitute minister, Tavares even published a photo with the former president on social media. However, he is seen behind the scenes as a person very close to Moraes and who is unlikely to vote against the minister, who has become the main executioner of Bolsonarism in the TSE and the STF (Federal Supreme Court) in recent years.

Tavares was nominated by Lula for a two-year term, which can be renewed for the same period. He occupies one of two court seats reserved for the barrister class. Of the other vacancies, three are occupied by members of the Supreme Court and two by members of the STJ (Superior Court of Justice) — the composition of the substitute magistrates follows the same rules and divisions as the titular ones.

Along with him, Minister Floriano Marques was appointed, who is also close to Moraes and is unlikely to vote differently than the head of the court.

The trial began last Thursday (22). At the time, the entire court session served to support Walber Agra, Bolsonaro’s defense and the Electoral Attorney General’s Office.

On Tuesday (27), the meeting was dominated by the rapporteur’s vote. Benedito said that he did not just analyze the meeting with ambassadors called by Bolsonaro in July last year and that gave rise to the PDT action.

The minister made an assessment of the scenario of the former president’s statements against the voting system and the repeated lies against electronic voting machines, stating that Bolsonaro “ostensibly violated” the duties of President of the Republic provided for in the Constitution, in particular that of “watching over for the free exercise of instituted Powers and political rights and for internal security”.

According to him, the former president “assumed unjustified direct antagonism with the TSE, seeking to victimize himself and discredit the competence of the technical body and the honesty of its ministers to bring the TSE’s performance to absolute international discredit”.

For the minister, Bolsonaro is “wholly and personally responsible for the intellectual conception” of the event that was the object of the action.

On the occasion, he also recalled the judgment in which the court approved the inclusion in the process of the draft seized in January this year at the home of former Minister of Justice Anderson Torres and stated that it was “a coup leader in essence”.
