Justice suspends appointment of Marinho to Sesc council – 06/20/2023 – Panel

The Federal Justice of São Bernardo do Campo (SP) suspended the appointment of the Minister of Labor, Luiz Marinho, to the council of Sesc (Social Service of Commerce).
The preliminary decision was made at the request of federal deputy Kim Kataguiri (União-SP) and ABC city councilor Glauco Braido (PSD), both linked to MBL (Movimento Brasil Livre).
The argument, accepted by the Court, is that Marinho’s appointment to the position, in a vacancy destined for the ministry he himself represents, violates the principles of morality and impersonality. The exercise of the function generates monthly payment of up to R$ 28,620.
Marinho nominated himself in place of the previous occupant of the vacancy, the national secretary of Solidarity Economy of the ministry, Gilberto Carvalho.
In the decision, the Justice considered that there was a conflict of interests in the fact that Marinho simultaneously occupied the positions of minister and representative of the portfolio in the council.
“If the authority is not allowed to appoint their spouse, partner or relative directly, collaterally or by affinity, obviously they cannot make the appointment fall on themselves, revealing a surprising form of nepotism that does not find support in the legal system” , says the injunction.
