The São Paulo court determined that Microsoft do Brasil must remove from the search platform, which uses artificial intelligence, “undue information” that imputes to a doctor the authorship of crimes involving sexual harassment, which “was practiced by a third party and by he investigated”. The injunction was given by Judge Jayter Cortez Junior, from the 7th Civil Court of Bauru/SP.
In the preliminary injunction, the judge determined a period of 48 hours for the platform to remove the information, under penalty of disobedience and a daily fine set at R$5,000 up to a limit of R$250,000. The lawsuit was filed by the doctor’s defense, due to the platform’s delay in removing the “reliable information”.
“The delay is obvious, as it is a large research platform with worldwide reach, used on a large scale by internet users to collect information and qualify professionals who are presenting false and serious data that threaten the honor and dignity of the author and which has been viewed by third parties, who have even warned him of what happened,” wrote the judge.
