Judge suspends impeachment process for mayor Carlos Sampaio, of the municipality of Amapá – News of Brazil

Judge Julle Anderson de Souza Mota, from the District of Amapá, granted an injunction request to determine the suspension of the process to revoke Mayor Carlos Sampaio’s mandate, until the merits are judged. The decision was taken in the trial of the writ of mandamus by councilor Dorivan dos Santos Sobral (PDT), against an allegedly illegal and abusive act attributed to Daymo João Sucupira Neto (president of the Chamber) and Willian Maciel da Silva.
According to the councilor, the complaint that instructed the initiation of the process came from Welligton Nascimento Bento, who claims to have gathered several documents proving the irregularities attributed to the investigated mayor. On November 6, the chamber of councilors, through councilor Daymo Sucupira, in the same legislative session, received, read and approved the request for investigation against Carlos Sampaio, having drawn, in the same session, the members of the processing committee, without councilor Dorivan dos Santos and councilor Ivanete Alves Ferreira were at the session, as they had been appointed by the mayor to represent the legislature at the event called FAMÍLIA ACOLHEDORA, which took place on the same date, in the city of Macapá.
Due to this mission, Dorivan did not have access to the documents in the complaint, nor was he able to vote or even qualify to be a member of the processing committee, as he did not know that the defendants were planning the maneuver to remove him from the city to receive and approve the complaint against the mayor, without even having published the agenda for calling the session.
Councilor Dorivan maintains that he would never have been absent if he had been informed that the defendants’ plan was precisely this. For this reason, since then, he has sought access to documents, session minutes and approved complaints, however, access has always been denied.
In the decision, judge Julle Anderson states that he found the clear and certain right of councilor Dorivan and the abusive act of Daymo João Sucupira Neto and Willian Maciel da Silva in failing to comply with the internal regulations of the Amapá city council and other legal regulations, including the organic law of the municipality and administrative improbity law.
“The smoke of good law is due to the non-compliance, on the part of the defendants, with the constitutional and regulatory principles of the city council chamber and organic law and the periculum in mora translates into the urgency that this measure requires, since the The ongoing legislative process takes place in the dark, without due knowledge by the petitioner of the evidence and documents that support it, being contaminated, apparently, with illegalities that could culminate in the nullity of the process of removing the mayor of Amapá”, wrote the judge in the decision, requesting information from the targets of the action within ten days.
