Judge denies PT’s request against Nikolas to delete post about Marielle

Judge Vivian Lins Cardoso, of the Federal District Court of Justice, denied a request presented by the PT against federal deputy Nikolas Ferreira (PL-MG) so that he would be forced to delete publications on social media in which he stated that the alleged mastermind of the death of councilwoman Marielle Franco would be a PT member.

On January 23, after the announcement of the alleged mastermind of the councilor’s crime, the deputy from Minas Gerais wrote on social media: “Who ordered Marielle to be killed? is finally answered [sic]. May justice be served against the PT leader, Domingos Brazão”.

The name of Domingos Brazão, counselor at the Rio de Janeiro Court of Auditors, as the alleged mastermind behind the murder, emerged after Ronnie Lessa’s accusation. Brazão is a former MDB politician who supported Dilma Rousseff’s (PT) campaign for the presidency of the Republic and was arrested in 2017 as part of Operation Lava Jato accused of corruption. The counselor’s connection with the PT arose after the publication of a photo of him with a sticker in support of former president Dilma Rousseff.

After Nikolas’ publication, the PT decided to file a request for emergency relief, claiming that the publications were “untrue and irresponsible”. And for this reason, they requested immediate deletion, in addition to the prohibition of disclosure, sharing and propagation of the content by Nikolas.

When delivering the decision, the judge pointed out that the requirements for granting urgent protection were not identified. “If on the one hand the right to honor and image deserves protection, on the other, the right to freedom of expression and the prohibition of censorship are envisaged.”, highlights the judge in a decision released by the CNN Brazil.

Given the lack of evidence, she decided to reject the request for urgent protection filed by the acronym. The PT has already informed that it intends to appeal the decision.

When commenting on the court’s decision, Nikolas highlighted that “there are serious people in Brazilian justice and above all committed to complying with the Constitution.” “What we ask for is not much, just the interpretation of the laws in an impartial and non-activist manner. And I have no doubt that the result will be like this. We continue.”, he wrote on the X network.
