Josenildo proposes law to reduce working hours for parents and guardians of autistic people – News of Brazil

Parents and guardians of autistic people may be entitled to a reduction in their workload so that they can dedicate themselves to monitoring their children. The proposal is from the federal deputy Josenildo Abrantes (PDT-AP), filed at the Federal Chamber last Friday, the 16th, and aims to guarantee the reduction of the working day from 20% to 50%, without changing remuneration.
“The reduction of working hours for parents and guardians of autistic children is a measure that the State can guarantee and provide opportunities for these children to reach their full potential, becoming autonomous adults and integrated into society”says the deputy, highlighting the importance of family participation in the care and special needs of their children, contributing to their development and well-being, as well as inclusion and equal opportunities for children with autism.
To be entitled to the benefit, the legal guardian must present to the employer the medical report that proves the diagnosis of Autism Spectrum Disorder (ASD) of the child. Only one of the parents will be entitled to reduced working hours. The reduction will be a maximum of 50%, proportionally to the degree of dependence of the child with ASD and according to the convenience of the employee and employer.
Employers must guarantee the benefit to their servants or collaborators and may not discriminate, dismiss or harm the worker with the reduction of remuneration or any other legal right for the one who takes advantage of the reduction of the working day, due to the care dedicated to the child with Autistic Spectrum Disorder. The employer or contracting authority may request periodic medical examinations to prove the need to continue reducing working hours.
In Amapá, state public servants are already benefiting from a similar law that reduces by up to 50% the working day for autistic servants, or those with severe or profound physical, visual or mental disabilities. The right extends to servers with family members in the same requirements. The law was authored by the State Executive Branch, under the management of then-Governor Waldez Góes.
Josenildo Abrantes is a member of the Parliamentary Front for the Protection of People with Autistic Spectrum Disorder in the Federal Chamber and has already made several propositions aimed at expanding benefits and rights to autistic people and their families, such as the rapporteurship in the Bill that aims to create Integral Assistance Centers for autistic people in the SUS; asked the Ministry of Education to encourage universities and colleges to offer the undergraduate course in Occupational Therapy, among others.
PL 3121/2023, for reducing the workload of parents and guardians of autistic people, goes on for appreciation in plenary, processing in committees for future approval in the Chamber and presidential sanction.
