Joana Darc’s law requires managers to report sexual crimes committed between employees

According to the parliamentarian, the law aims to establish yet another mechanism to face impunity for crimes against sexual dignity
Manaus (AM) – Law No. 6,198 of January 3, 2023, authored by state deputy Joana Darc (União Brasil), requires administrators and managers to notify the police authorities of the occurrence or evidence of a crime against sexual dignity in which the victims or perpetrators are employees of your establishment.
According to the parliamentarian, the law aims to establish yet another mechanism to face impunity for crimes against sexual dignity, according to the Penal Code, whose author of the fact or the victim is an employee or service provider public or private establishment located within the scope of the State of Amazonas.
“There is a constant number of cases of cyber crimes involving exposure, on social networks, of pornographic images of women, without their consent, committed by employees of companies, whose victims also work in the same place. The Law comes exactly to help protect the victims of these abusive practices and put the perpetrator in jail”, explains Joana Darc.
In its Art. 1, § 2, the Law establishes that the communication must be carried out by any means made available by the Civil Police of Amazonas, within a period of up to 48 hours (forty-eight hours) after becoming aware of the fact. When the crime is committed against a woman or against a child or adolescent, the communication must also be made, within 72 (seventy-two) hours, to the Department of Policy to Combat Violence against Women of the State, to the Secretariat or Coordination of woman from the municipality and Public Ministry of Amazonas; and to the Police Department for Children and Adolescents of Amazonas, and the Guardianship Council of the municipality and also to the Public Ministry of Amazonas, respectively, so that the appropriate measures can be taken.
The author of the Law also emphasizes the importance of reporting to reduce and help in the fight against this type of crime. “The responsibility for confronting violence is collective, because without information passed on by society, the State is unable to investigate the facts and punish those responsible. Therefore, when you become aware, by any means, of a fact that constitutes a sexual crime, report it, as it will help save the lives of many women”, he adds.
Non-compliance with the Law will lead to the administrative liability of the administrator or its directors, in accordance with the applicable legislation, and will subject the offender, when an individual or legal entity governed by private law: Warning, upon the first assessment of the violation; and Fine, from the second assessment, set between R$ 5,000.00 (five thousand reais) and R$ 100,000.00 (one hundred thousand reais).
